Please read these Terms of Service carefully before using 99HomeBazaar. These terms govern your access to and use of our platform and constitute a legally binding agreement between you and 99HomeBazaar. We've written them in plain language — no unnecessary jargon.
ACCEPTANCE OF TERMS
Agreement to Terms
By accessing or using the 99HomeBazaar platform — including our website, mobile app, and any related services — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
Eligibility
You must be at least 18 years of age to use our services. By using the platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
OUR SERVICES
Platform Description
99HomeBazaar is a real estate marketplace that connects property buyers, sellers, and renters with certified agents across 28 cities in India. We provide tools to search, list, and enquire about residential and commercial properties.
Not a Real Estate Agent
99HomeBazaar is a technology platform, not a real estate brokerage. We facilitate connections between users and certified agents but are not a party to any property transaction. All transactions are between users and agents/property owners directly.
Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.
USER ACCOUNTS
Account Registration
To access certain features, you must create an account with accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Account Security
You agree to notify us immediately at legal@99homebazaar.com if you suspect any unauthorised use of your account. We will not be liable for any loss resulting from unauthorised account access that occurs without our fault.
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or harm other users. You may also delete your account at any time from your dashboard settings.
PROPERTY LISTINGS
Accuracy of Listings
All properties listed on our platform are physically inspected by our team before going live. However, property details, availability, and pricing are subject to change. Users are advised to independently verify all information before making any financial commitments.
Listing Rules for Sellers/Agents
If you list a property on our platform, you warrant that you have the legal right to do so, all information provided is accurate and not misleading, photos are genuine and represent the actual property, and you will promptly update or remove listings that are no longer available.
Prohibited Listings
You may not list properties that are subject to legal disputes without disclosure, properties you do not have authority to sell or rent, or duplicate listings of the same property. Violations may result in immediate listing removal and account suspension.
USER CONDUCT
Prohibited Activities
You agree not to: scrape or harvest data from our platform; use automated tools to access our services; attempt to circumvent our verification systems; post false, misleading, or fraudulent listings; harass, threaten, or defraud other users; or use our platform for any illegal purpose.
Communication Standards
All communications through our platform must be professional and respectful. We reserve the right to monitor communications for safety purposes and to remove content that violates our community standards.
FEES & PAYMENTS
Transparent Pricing
Any fees applicable to our premium services are clearly displayed before you commit to a purchase. We do not charge hidden fees. All prices are inclusive of applicable taxes unless stated otherwise.
Refund Policy
Subscription fees are non-refundable once a billing period has commenced. For one-time service fees, refund requests must be submitted within 7 days of purchase and are subject to review. Refunds will be processed within 10 business days.
Payment Security
All payments are processed through PCI-DSS compliant payment gateways. We do not store your full payment card details on our servers.
INTELLECTUAL PROPERTY
Our Content
All content on the 99HomeBazaar platform — including logos, design, text, software, and data compilations — is the property of 99HomeBazaar or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.
Your Content
By submitting content (such as property photos or descriptions) to our platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with our services. You retain ownership of your content.
DISCLAIMERS & LIABILITY
No Investment Advice
Nothing on our platform constitutes financial, legal, or investment advice. Property values fluctuate and past performance does not guarantee future results. Always consult qualified professionals before making property investment decisions.
Limitation of Liability
To the maximum extent permitted by law, 99HomeBazaar shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform, including loss of profits, data, or business opportunities.
Third-Party Links
Our platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of those sites. Visiting them is at your own risk.
GOVERNING LAW
Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
Dispute Resolution
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@99homebazaar.com. We will make good-faith efforts to resolve disputes within 30 days.
CHANGES TO TERMS
Updates
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on our platform at least 14 days before the changes take effect. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
